Surrogacy generally means is a legal arrangement in which a woman agrees to become pregnant and bear a child for the benefit of another person who will become the kid’s parent.

  • The legal problems surrounding surrogacy in India are rather complicated.
    The reason for this is that the technique of surrogacy is primarily controlled by the ICMR’s standards. Because there is no legislative support for it.
  • The commissioning parents and the surrogate mother were both protected by the standards. It did, however, make sex-selective surrogacy treatments illegal.

  • The condition that the donor be one of the commissioning parents
  • Only the commissioning parents’ names should appear on the birth certificate
  • In the case of the surrogate mother, there is a life insurance policy
  • Finally, both the commissioning parents and the surrogate mother have the right to privacy
